Terms and Conditions

FOR FREE PALLET RACK INSPECTION

1. Nature of Inspection

DURASTONE CONSTRUCTION LLC (“Company”) offers free pallet rack inspections strictly as a courtesy service. These inspections are conducted on a limited, visual-only basis to note readily observable damage to pallet rack components. The service is provided as available, is not guaranteed, and may be declined, rescheduled, or discontinued by the Company at its sole discretion and without liability.

2. No Structural or Engineering Services

The Company is not a licensed engineering firm and does not provide engineering, architectural, or structural analysis services. The inspection does not include load calculations, structural certification, or determination of weight capacity. Nothing in the inspection or any related report should be interpreted as a representation or guarantee that the pallet rack system is structurally sound, code-compliant, or safe for continued use.

 

The inspection does not determine whether the pallet rack system:

  • is structurally sound,

  • complies with OSHA, ANSI, RMI, or other regulatory standards, or

  • can support any specific weight or load.

3. Scope Limitations

The inspection is limited in scope to conditions that are visibly accessible at the time of inspection. It is not exhaustive and may not reveal hidden damage, wear, corrosion, improper installation, overloading, or other safety concerns.

The inspection and report are intended solely to identify apparent visible damage and should not be relied upon as a warranty, guarantee, or certification of the pallet rack’s overall safety, integrity, or compliance with applicable standards.

 

Conditions can change over time; the inspection reflects only the status of the equipment at the moment of review.

4. Customer Responsibility

The Customer remains solely responsible for:

  • The safe use, inspection, and maintenance of its pallet rack systems;

  • Ensuring compliance with OSHA, ANSI, RMI, local building codes, and any other applicable safety or regulatory standards;

  • Promptly addressing any issues noted in the inspection report; and

  • Obtaining the services of a qualified professional engineer or other licensed professional if a structural or load-capacity evaluation is required.

5. Disclaimer of Liability

The Company, its officers, employees, agents, and subcontractors shall not be held responsible or liable for:

  • Any damages, losses, injuries, delays, or expenses arising out of or related to the use, misuse, or condition of the pallet rack system;

  • Any defects, hazards, or conditions not observed or not reported during the inspection; or

  • Any reliance placed upon the inspection or report for purposes beyond its expressly stated limitations.

6. Limitation of Liability

To the fullest extent permitted by law, the total cumulative liability of the Company in connection with or arising out of the inspection and report, whether in contract, tort, or otherwise, shall not exceed the sum of one hundred dollars (USD $100.00). This limitation applies even if the Customer has paid nothing for the inspection service.

7. Acceptance of Terms

By accepting, scheduling or relying upon this inspection, the Customer acknowledges and agrees to the above terms and conditions.
